To provide the Services, we collect and have collected over the past 12 months personal information about you from a variety of sources, as set out below. The information that we collect and use varies depending on how you interact with us.

       Companies who support our Site and Services, such as Shopify.

       Our payment processors, who collect payment information (e.g., credit or debit card information, billing address) to process your payment in order to fulfill your orders and provide you with the products or services you have requested.

       Mailchimp (operated by Intuit), our email marketing service provider, who receives your email address and name for the purpose of sending you promotional communications you have opted into.

Any information we obtain from third parties will be treated in accordance with this Privacy Policy. We are not responsible or liable for the accuracy of the information provided to us by third parties and are not responsible for any third party's policies or practices.

3. Payment Processing and Card Data

Bond Knives does not directly collect, store, process, or transmit your full payment card information. All payment card data is collected and processed directly by our third-party payment processors. We are committed to working with payment processors who comply with the Payment Card Industry Data Security Standard (PCI DSS).

Specifically:

       We do not store your full credit or debit card numbers on our systems.

       We do not have access to your complete card data following the completion of a transaction.

       Our payment processors use secure encryption and tokenization technologies to protect your payment information.

       We may retain limited transaction confirmation data (e.g., the last four digits of your card, card type, billing address) solely for order management, customer support, and fraud prevention purposes.

By providing your payment information through our checkout process, you are providing it directly to our payment processor(s), subject to their privacy policies and PCI DSS compliance obligations.

4. How We Use Your Personal Information

4.1 Providing Products and Services

We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges, and to enable you to post reviews.

4.2 Email Marketing

We use your personal information for email marketing purposes to send you promotional communications about our products, offers, and updates. Our email marketing is conducted exclusively through Mailchimp (operated by Intuit). We only send marketing emails to individuals who have opted in to receive them, and you may opt out at any time using the unsubscribe link in any marketing email. We do not engage in paid digital advertising (such as paid social media ads, search engine advertising, or display advertising) at this time, and we do not use your personal information for such purposes.

4.3 Security and Fraud Prevention

We use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately.

4.4 Communicating with You

We use your personal information to provide you with customer support and improve our Services. This is in our legitimate interests in order to be responsive to you, to provide effective services to you, and to maintain our business relationship with you.

5. How We Disclose Personal Information

In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:

       With vendors or other third parties who perform services on our behalf (e.g., IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping).

       With service providers who help us operate our Site and Services, including Shopify (e-commerce platform) and Mailchimp (email marketing). These service providers will use your information only as directed by us and in accordance with their own privacy policies.

       With Meta Platforms, Inc. (Facebook/Instagram) solely to the extent that you interact with our organic social media presence on those platforms. We do not purchase advertising services from Meta or use Meta-based tracking tools on our Site.

       When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.

       With our affiliates or otherwise within our corporate group (including Ti2 Design, HiTex Gear, Bond Knives, along with any other brands owned by us), in our legitimate interests to run a successful business.

       In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations, to enforce any applicable terms of service, and to protect or defend the Services, our rights, and the rights of our users or others.

We share limited personal information with Mailchimp solely to send promotional emails to customers who have opted in to receive them. This sharing is limited to your name and email address. We do not sell personal information, and we do not share personal information with third parties for independent advertising or marketing purposes beyond the email marketing described above.

 

We do not use or disclose sensitive personal information for the purposes of inferring characteristics about you.

6. Data Retention

How long we retain your personal information depends on the purpose for which it was collected and our legal obligations. In general:

       Account information: Retained for as long as your account remains active, plus up to 3 years following account closure to allow for dispute resolution and legal compliance.

       Order and transaction information: Retained for up to 7 years to comply with tax, accounting, and legal obligations.

       Marketing and communications data: Retained until you opt out or withdraw consent, after which we will remove you from active marketing lists within 30 days.

       Security and fraud-related data: Retained for up to 5 years to support fraud investigations and legal proceedings.

       Usage Data and cookies: Retained in accordance with our cookie policy and the data retention practices of our analytics partners, generally for no longer than 26 months.

When personal information is no longer needed for the purposes for which it was collected, we will securely delete, destroy, or anonymize it as described in Section 9 (Security and Data Protection) below.

7. Security and Data Protection

7.1 Security Measures

We implement and maintain reasonable administrative, technical, and physical security measures designed to protect your personal information from unauthorized access, use, alteration, or destruction. These measures include:

       Encryption of data in transit using SSL/TLS protocols.

       Access controls limiting employee access to personal information on a need-to-know basis.

       Regular review of our information collection, storage, and processing practices.

       Working with PCI DSS-compliant payment processors to handle payment card information.

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecured channels to communicate sensitive or confidential information to us.

7.2 Data Breach Notification (Hawaii HRS §487N)

In the event of a security breach that we reasonably believe has caused or may cause the unauthorized access to or acquisition of personal information of Hawaii residents, we will notify affected individuals as required by Hawaii Revised Statutes Chapter 487N. Specifically:

       We will provide notice in the most expedient time possible following discovery of a breach.

       Notice will be provided by written notice, electronic notice (where the affected person has consented to receive electronic notice), or substitute notice if the cost of providing direct notice would exceed $100,000 or the number of affected persons exceeds 200,000.

       We will also notify the State of Hawaii Office of Consumer Protection as required by applicable law.

7.3 Destruction of Personal Records (Hawaii HRS §487R)

In accordance with Hawaii Revised Statutes Chapter 487R, when we dispose of records containing personal information, we take reasonable measures to protect against unauthorized access to or use of that information. Such measures include:

       Shredding or otherwise destroying physical documents containing personal information before disposal.

       Permanently erasing, degaussing, or physically destroying electronic media containing personal information.

       Directing our service providers to implement comparable destruction practices for any personal information they hold on our behalf.

8. User-Generated Content

The Services may enable you to post product reviews and other user-generated content. If you choose to submit user-generated content to any public area of the Services, this content will be public and accessible by anyone.

We do not control who will have access to the information that you choose to make available to others, and cannot ensure that parties who have access to such information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information that you make publicly available, or for the accuracy, use, or misuse of any information that you disclose or receive from third parties.

Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

10. Children's Data

The Services are not intended to be used by children under the age of 18, and we do not knowingly collect any personal information about children. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.

As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 18 years of age.

Please note that if you visit our Site with the Global Privacy Control opt-out preference signal enabled, depending on where you are, we will automatically treat this as a request to opt-out of the "sale" or "sharing" of information for the device and browser that you use to visit the Site.

       Right to Limit and/or Opt Out of Use and Disclosure of Sensitive Personal Information: You may have a right to direct us to limit our use and/or disclosure of sensitive personal information to only what is necessary to perform the Services or provide the goods reasonably expected by an average individual.

       Restriction of Processing: You may have the right to ask us to stop or restrict our processing of personal information.

13. International Users

Please note that we may transfer, store and process your personal information outside the country you live in, including the United States. Your personal information is also processed by staff and third-party service providers and partners in these countries.

If we transfer your personal information out of Europe, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.
